These Terms & Conditions (“Terms”) govern your use of the services provided by Curated by CAIA (“CAIA,” “we,” “us,” or “our”), including our fashion sourcing, personal shopping, styling, purchasing, and related services.
By submitting a sourcing request, approving a purchase, paying an invoice, or otherwise engaging CAIA to provide services, you agree to these Terms.

CAIA provides personalized fashion sourcing and shopping services to clients seeking designer fashion, handbags, shoes, accessories, jewelry, and other luxury goods.
We work with a network of boutiques, department stores, brands, retailers, and other suppliers in the United States and internationally to locate items requested by our clients.
Unless expressly stated otherwise, CAIA is an independent sourcing service and is not affiliated with, authorized by, sponsored by, or endorsed by any designer brand referenced on our website, social media, communications, or sourcing proposals.

You may submit a sourcing request through our website, email, WhatsApp, Instagram, or another communication channel offered by CAIA.
Please provide as much information as possible, including the designer or brand, item, size, color, reference image, budget, and any other relevant preferences.
Submitting a request does not guarantee that an item will be located or available for purchase.
Availability, pricing, condition, delivery estimates, and other product information may change at any time and remain subject to confirmation by the applicable retailer or supplier.

When we locate an item, we will provide you with available information regarding the item and the total amount payable to CAIA or an estimate of that amount.
Your quote may include:
the cost of the merchandise;
applicable sales taxes;
CAIA's sourcing or service fee;
shipping and handling;
payment-processing fees, where applicable; and
any other costs disclosed to you before purchase.
International customs duties, import taxes, brokerage charges, or similar destination charges may be payable separately as described below.
A quote does not reserve an item unless we expressly tell you otherwise.
Luxury merchandise can sell quickly. Pricing and availability therefore remain subject to change until the item has been successfully purchased.
Once you instruct CAIA to proceed with a purchase, including through written approval by WhatsApp, text message, email, Instagram, our website, or another agreed communication method, you authorize us to purchase the item on your behalf in accordance with the information provided to you.

CAIA charges sourcing or service fees for items and services provided to clients.
The applicable fee will be communicated to you before you commit to the purchase or service.
Unless otherwise expressly agreed in writing, sourcing and service fees compensate CAIA for the work involved in locating, securing, coordinating, purchasing, and facilitating your request.
Once CAIA has successfully sourced an item and you have authorized its purchase, our sourcing or service fee is non-refundable, including if you later decide to return or exchange the merchandise.

Payment terms will be communicated to you when your item or service is confirmed.
Unless otherwise agreed in writing, invoices are due upon receipt. CAIA is not required to release or ship merchandise until all amounts due have been paid in full.
Payments may be processed through third-party payment providers, including Stripe or other payment platforms made available by CAIA.
Where disclosed before payment, payment-processing or credit-card fees may be added to the amount payable.
By submitting payment, you represent that you are authorized to use the payment method provided.

For sourcing requests, CAIA may purchase merchandise from a third-party retailer or supplier on your behalf after receiving your authorization.
The underlying merchandise is supplied by the applicable third party. Each retailer or supplier may maintain its own policies regarding availability, processing times, cancellations, returns, exchanges, repairs, warranties, and refunds.
Where reasonably available, CAIA will provide relevant retailer information or policies to you upon request.
Because CAIA often purchases merchandise specifically in response to an individual client's request, you should not authorize a purchase unless you intend to complete the transaction.

CAIA takes the authenticity of merchandise seriously.
We endeavor to source merchandise through reputable sources, including designer boutiques, department stores, established retailers, and trusted suppliers.
Where applicable and available, merchandise may be accompanied by original packaging, receipts, authenticity materials, dust bags, boxes, or other items supplied by the retailer. The exact inclusions will vary by product and source and are not guaranteed unless expressly confirmed to you.
CAIA does not manufacture the merchandise it sources and cannot make representations on behalf of the manufacturer beyond information reasonably available to us from the retailer or supplier.

If you submit a sourcing inquiry but have not yet authorized CAIA to purchase an item, you may withdraw your request.
Once you authorize CAIA to proceed and the merchandise has been purchased or a non-refundable commitment has been made to a retailer or supplier on your behalf, the transaction generally cannot be cancelled through CAIA.
If cancellation remains possible under the applicable retailer's policies, we will make reasonable efforts to assist you.
Any CAIA sourcing or service fee already earned remains non-refundable.
Nothing in these Terms limits any cancellation right that cannot lawfully be excluded under applicable consumer-protection law.

Because CAIA sources merchandise from third-party retailers and suppliers, returns and exchanges are subject to the return policy of the retailer or supplier from which the merchandise was purchased, unless CAIA expressly provides different terms to you before purchase.
Some merchandise may be final sale or otherwise ineligible for return or exchange.
If you would like to request a return or exchange, please contact CAIA as soon as possible. We will make reasonable efforts to facilitate an eligible return or exchange with the applicable retailer.
You are responsible for costs associated with a return or exchange unless otherwise required by law or agreed by CAIA in writing. These costs may include return shipping, insurance, customs charges, retailer fees, currency-conversion differences, or other expenses.
CAIA sourcing and service fees are non-refundable, even when a retailer accepts a return or exchange.
A refund for merchandise, where applicable, will be subject to the retailer's approval and will generally not be issued by CAIA until the corresponding refund has been received or confirmed from the retailer.
Nothing in this section limits rights that cannot lawfully be excluded. -
CAIA relies in part on product information, photographs, sizing information, descriptions, and other details supplied by retailers, brands, and suppliers.
We make reasonable efforts to communicate this information accurately but cannot guarantee that photographs or digital displays reproduce colors, textures, proportions, or other characteristics perfectly.
Sizing may vary considerably between designers, products, seasons, and regions. Any sizing guidance provided by CAIA is intended to assist you but cannot guarantee fit.
Handmade products and products made from natural materials—including leather, exotic materials where legally permitted, gemstones, metals, and other natural components—may exhibit natural variations.
Such variations are not necessarily defects.

Shipping charges and estimated delivery timing will be communicated where reasonably possible before shipment.
CAIA may ship merchandise directly to you or arrange for merchandise to be delivered to CAIA before being forwarded to your designated delivery address.
Delivery dates are estimates unless expressly guaranteed in writing.
Once merchandise has been transferred to a shipping carrier, delays caused by customs, weather, carrier operations, governmental action, incorrect delivery information, or other circumstances outside CAIA's reasonable control may affect delivery.
You are responsible for providing a complete and accurate shipping address and for ensuring that someone is available to receive or sign for a shipment where required.
If a shipment is lost or damaged in transit, please notify CAIA promptly. We will reasonably assist with any available carrier or insurance claim.

CAIA works with clients and suppliers internationally.
Unless expressly stated otherwise in your quote, customs duties, import taxes, VAT, brokerage fees, clearance fees, and other charges imposed by the destination country are not included in the amount paid to CAIA and are the client's responsibility.
These charges are determined by governmental authorities, customs agencies, and/or shipping carriers and are outside CAIA's control.
CAIA cannot guarantee the amount of duties or taxes that may be assessed.
You are responsible for complying with applicable import requirements in your destination country.
Refusing delivery or failing to pay applicable customs charges does not automatically entitle you to a refund. Any refund remains subject to the applicable retailer's policies and recovery of the merchandise.

Prices and quotes may be subject to sales tax or other taxes depending on where merchandise is purchased, delivered, or otherwise considered taxable.
Applicable taxes will be charged where required.

If you believe there is an error with a transaction, please contact CAIA promptly so that we can attempt to resolve the issue.
You agree not to initiate a chargeback or payment dispute for a validly authorized purchase solely because:
you changed your mind after authorizing the purchase;
an item is final sale;
a retailer declined a return or exchange;
CAIA's sourcing fee is non-refundable;
customs duties or import taxes were assessed;
delivery was delayed by circumstances outside CAIA's reasonable control; or
another circumstance occurred that was disclosed to you before your authorization.
Nothing in this provision prevents you from exercising legitimate rights available through your card issuer or applicable law.
CAIA reserves the right to provide transaction records, invoices, communications, shipping documentation, proof of authorization, and other relevant information to payment processors or financial institutions when responding to a payment dispute.

CAIA is not responsible for the independent acts or omissions of third-party retailers, brands, suppliers, shipping carriers, payment processors, customs authorities, or other service providers outside our reasonable control.
We will, however, make reasonable efforts to assist clients in resolving legitimate issues involving purchases we facilitate.
References to third-party trademarks, brand names, product names, and logos are for identification and descriptive purposes only. All trademarks remain the property of their respective owners.

To the fullest extent permitted by applicable law, CAIA will not be liable for indirect, incidental, special, or consequential losses arising from circumstances outside our reasonable control or from the acts or omissions of independent third parties.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

CAIA will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including shipping disruptions, customs delays, natural disasters, severe weather, strikes, governmental actions, retailer cancellations, inventory errors, supply-chain interruptions, or failures of third-party systems.
We will make reasonable efforts to keep you informed when such circumstances materially affect your order.

Unless otherwise stated, the content of the Curated by CAIA website and CAIA-created materials—including text, graphics, branding, photographs, illustrations, and design elements—is owned by or licensed to CAIA and may not be reproduced or commercially used without permission.
Third-party trademarks and imagery remain the property of their respective owners.

We may collect and process personal information necessary to provide our services, process payments, communicate with you, arrange purchases, and deliver merchandise.
Where necessary to fulfill your request, certain information may be shared with retailers, payment processors, shipping carriers, and other service providers.
Our collection and use of personal information is further described in our Privacy Policy.

By contacting CAIA through our website, WhatsApp, email, Instagram, or another communication channel, you agree that we may communicate with you through that channel in connection with your inquiry, sourcing request, purchase, delivery, or customer-service matter.
Marketing communications will be handled in accordance with applicable law and any consent requirements that apply.

We may update these Terms from time to time to reflect changes to our services, business practices, or applicable legal requirements.
The version applicable to a transaction will generally be the version in effect when you authorize the applicable service or purchase.
